Mandatory Programming Changes for ABI In-Bond Transactions
Attention Automated Broker Interface, ACE Portal Accounts: Approximately 6 months from March 16, 2012, certain ABI applications will be transitioned to ACE as part of the ACE M1 Ocean and Rail Deployment.  When this transition takes place, you will no longer be able transmit or receive data for  anumber of ABI capabilities using ACS.

AAEI Joins Opposition to Currency Bill
AAEI has joined 44 other trade associations in a letter objecting to any proposed legislation to require unilateral action by the United States against China’s currency. The letter to Senate Majority Leader Harry Reid (D-NV) and Minority Leader Mitch McConnell (R-KY) promotes a multilateral approach to exchange-rate disputes as the proper way to achieve success in addressing China’s currency and exchange rate policies.

CSC Urges Action on Exports
The Coalition for Security and Competitiveness has sent a letter to President Obama restating its strong support for Export Control Reform, including publication of a proposed rule providing a regulatory construct for moving items from the USML to the CCL.

Big Win for Trade
CBP and US Treasury have decided not to adopt NAFTA’s Rules of Origins (ROO) for all trade (i.e., use the tariff shift rules), ceding the trade community’s concern that switching to NAFTA ROO is complex and leads to anomalous findings. Instead, CBP will continue to use its traditional “substantial transformation rule” for country of origin determination.  AAEI submitted a comment on the proposal in 2008, as did many other trade associations, all of whom argued at length against it.

AAEI Joins Opposition to Amend the Atomic Energy Act
AAEI joins 14 other leading industry associations in a letter to the bipartisan leadership of the House of Representatives strongly opposing an untitled bill (H.R.1280) that would amend the Atomic Energy Act by requiring congressional approval of agreements for peaceful nuclear cooperation with foreign countries. The bill would impose substantial new requirements and congressional approval for sales of U.S. goods and services associated with the development of nuclear power plants abroad.

AAEI Joins Opposition to California Port Drayage Owner-Operator Ban
AAEI has added its name to the list of 30 associations strongly opposed to a California state bill that would effectively ban all independent owner-operators from operating at California ports. The practical effect of this bill is to ban all independent contractors, also known as owner-operators, from California ports and negatively impact activity at ports.

AAEI files an amicus brief urging the US Supreme Court to take up the government's reclamation fee on coal, which may be unconstitutional under the "Export Clause".

CBSA eManifest Initiative on Track
Phased implementaton continues in Canada for the CBSA eManifest Initiative. It will require trade partners in all modes of transportation to submit cargo and passenger data to the CBSA prior to arrival at the border.

CBP Commissioner Takes Action
CBP Commissioner Alan Bersin is taking action on some of the trade community's proposals to improve Customs regulations and operations. AAEI joined with 15 other trade and industry groups in composing a list of proposals to the new commissioner. He issued a reply letter on July 23, 2010.

Administration Outlines Export Reform
National Security Advisor General James L. Jones provided a status report on the Obama Administration's plans for the coming 3-phase approach to export control reform.
In April 2010, US Defense Sec. Robert Gates outlined Obama Administration's export reform plan. The plan relies on four key reforms: a single export control list, a single licensing agency, a single enforcement coordination agency and a single information technology system.

Brazil's Retaliation List
Brazil's Retaliation ListBrazil suspended plans to raise tariffs on exported US goods following a negotiated agreement in March 2010. The retaliation plans stemmed from the US’s failure to comply the World Trade Organization’s ruling in the Upland Cotton Dispute. The retaliation list included a wide variety of goods. Brazil also issued a proposed retaliation affecting US intellectual property rights.

CBP Begins Full ISF Enforcement in Jan. 2010
Importer Security Filing (ISF) is being fully enforced on all imported merchandise entering the United States by ship. Under the rule, before merchandise arriving by ship can be imported into the US, importers or their agents must electronically submit the cargo information to CBP at least 24-hours before lading at the foreign port of export.

MTB Analysis Released
The Tariff Action Coalition has released its analysis of the Miscellaneous Tariff Bill and calls it unique legislation that provides vast benefits to manufacturers. AAEI is a supporter of the MTB and is participating in the coalition to get the bill passed as duty suspension provisions expire at the end of the year.
