The American Association of Exporters and Importers (AAEI) reaffirms the vital role of the U.S. Supreme Court in upholding the Constitution and ensuring the proper balance of powers in matters of trade and national security. The Court’s review of tariffs imposed under the International Emergency Economic Powers Act (IEEPA) is a critical step in determining the scope of executive authority and the legal limits of presidential action in imposing trade measures. Judicial oversight in this area helps preserve transparency, accountability, and the rule of law—principles essential to maintaining confidence in the U.S. trade system and protecting the rights and interests of businesses and consumers alike.

Since the start of the second Trump Administration, conversations surrounding tariffs have been at the top of the agenda. AAEI understands the Trump Administration’s goal to create greater balance in U.S. trade relationships and overall fair-trade practices.

AAEI urges Congress and the Administration to resolve trade disputes cooperatively through:

  • Congressional Oversight: Trade policy should be set through statutes, ensuring stability.
  • Transparent Trade Policy: Existing statutes provide notice and comment periods.
  • Strengthening U.S. Trade Leadership: A cooperative approach will enhance growth and reinforce U.S. leadership.
